PAGES BY POSTPADDY — TERMS OF SERVICE

These Terms of Service (“Terms”) are a legal agreement between PostPaddy LLC (“PostPaddy”, “we”, “us”, “our”) and the person or entity using Pages by PostPaddy (“Customer”, “you”). These Terms govern your access to and use of Pages by PostPaddy, including our web and mobile apps, dashboards, templates, editor tools, analytics, A/B testing and optimization features, APIs, documentation, and related services (collectively, the “Service”).

By creating an account, clicking “I agree,” or using the Service, you accept these Terms. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.

Not offered to EU/UK. The Service is not offered to residents of the European Union or the United Kingdom at this time. We may block signups and access from those regions. If you are located there, do not use the Service.

Age. You must be 18 years or older to use the Service.

  1. Definitions

  • Brand” means a workspace or business profile you manage in PostPaddy.

  • Page” means any landing page you create, host, publish, or manage through the Service.

  • Variant” means a version of a Page used in an experiment (for example A vs B).

  • Experiment” means any A/B test, split test, multi-variant test, or optimization run.

  • Submission” means information a visitor submits through a form on your Page (for example name, email, phone, message).

  • Visitor Data” means data generated when visitors interact with your Pages (for example page views, clicks, scroll, referrers, device signals, and IP address).

  • Customer Content” means all content you provide or publish through the Service (text, images, videos, logos, trademarks, offers, and form fields).

  • AI Features” means features that generate or suggest content using machine learning or large language models.

  • Third Party Services” means third party services connected to or linked from your Pages (for example Meta Pixel, Google Analytics, payment links, CRM tools, domain registrars).

  1. The Service

2.1 What the Service does

Pages by PostPaddy helps you:

  • create and publish landing pages,

  • edit pages using a chat editor and/or visual builder,

  • connect custom domains (where available),

  • collect leads via forms and manage Submissions,

  • track conversions and events,

  • run Experiments and (on some plans) automated optimization.

We may change, add, or remove features at any time.

2.2 Accounts, teams, and roles

  • Your account may include multiple Brands.

  • Brand owners and admins control access and permissions.

  • You are responsible for actions taken by anyone with access to your account or Brand.

  • You must keep credentials secure.

2.3 Verification and protective controls

We may request verification or additional information to reduce fraud, abuse, and platform risk. We may pause publishing or Experiments until verification is completed.

2.4 Plan limits, usage limits, and credits

Plans may include limits (examples):

  • number of published Pages,

  • number of custom domains,

  • monthly page views and events,

  • number of Submissions,

  • Experiments/optimization features,

  • AI or optimization credits.

If you exceed limits, we may throttle, pause Experiments, disable publishing, restrict features, or require an upgrade.

  1. Your responsibilities

3.1 Your content and offers

You are solely responsible for:

  • the accuracy of your Customer Content (including claims, prices, discounts, and availability),

  • any products or services you offer,

  • compliance with advertising and consumer protection laws,

  • providing any required disclosures (refund policy, terms, disclaimers, and privacy notices).

You represent and warrant that you have all rights needed to use and publish Customer Content, including rights to images, trademarks, and logos.

3.2 Privacy notices and consent for visitors

If your Pages collect data (forms) or use tracking (cookies, pixels, analytics):

  • you are responsible for providing the required notices to visitors,

  • you are responsible for obtaining consent where required,

  • you are responsible for configuring any cookie banner or consent tool you need,

  • you are responsible for complying with marketing laws for any follow up communication.

3.3 No illegal or harmful use

You may not use the Service to publish or promote:

  • illegal goods or services,

  • counterfeit or infringing content,

  • scams, deceptive offers, or fraudulent claims,

  • hate, harassment, or threats,

  • malware, phishing, or harmful code,

  • exploitation of minors or any child sexual content (zero tolerance).

We may remove content or suspend accounts that violate these rules or create unacceptable risk.

3.4 Traffic sources and ad platform policies

You are responsible for ensuring your Pages and traffic sources comply with third party ad platform and tracking policies (for example Meta, Google).

  1. Domains, DNS, and SSL

4.1 Domain ownership

If you connect a custom domain:

  • you represent you own or control the domain and have authority to change DNS,

  • you are responsible for your registrar account and DNS settings,

  • domain propagation and registrar downtime are outside our control.

4.2 SSL certificates

Where we provide SSL, we may provision and renew certificates through third party certificate authorities. We do not guarantee uninterrupted issuance or renewal due to dependencies outside our control.

4.3 Domain disputes

We will not participate in disputes about domain ownership, Brand ownership, or account ownership, and we disclaim liability related to such disputes.

  1. Experiments, A/B testing, and optimization

5.1 No guaranteed results

Experiment features are tools, not promises. Results depend on traffic, audience, seasonality, offer quality, and many factors outside our control.

We do not guarantee:

  • conversion rates,

  • lead quality,

  • statistical significance,

  • business outcomes.

5.2 Experiment operation

  • Experiments may use cookies or similar identifiers to assign a visitor to a Variant.

  • We may set default traffic splits and may adjust splits for stability and performance.

  • You can stop or override Experiments (where the product supports it).

5.3 Algorithm and feature changes

We may update Experiment methods and optimization logic over time. Historical reporting may change as methods improve.

5.4 Recommendations and AI outputs

Any optimization recommendation or AI output is a suggestion. You must review and approve changes before publishing.

  1. AI Features

6.1 AI is “as is”

AI outputs may be inaccurate, incomplete, or unsuitable for your use case. You are responsible for reviewing AI outputs for legal, brand, and factual accuracy.

We do not guarantee originality or non infringement of AI outputs.

6.2 Your inputs

You control what you submit to AI Features. Do not submit sensitive information unless necessary.

  1. Third Party Services and tracking

Your use of Third Party Services is subject to their terms and privacy policies. PostPaddy does not control Third Party Services and is not responsible for their security, uptime, policy decisions, or fees.

If you embed third party scripts or pixels, you are responsible for:

  • having the right notices and consents,

  • complying with third party requirements,

  • any claims or liabilities arising from that integration.

  1. Intellectual property and licenses

8.1 Your content

You own Customer Content. You grant PostPaddy a non exclusive, worldwide, royalty free license to host, store, copy, process, adapt (for formatting and technical display only), transmit, and display Customer Content as necessary to provide and operate the Service, including to publish your Pages publicly.

8.2 Our technology

We own the Service, software, templates we provide, and Documentation. You may not copy, reverse engineer, resell, or create a competing product based on the Service.

8.3 Feedback

If you provide feedback, you grant us the right to use it without restriction or compensation.

  1. Fees, billing, renewals, and taxes

If the Service (or parts of it) are paid:

  • subscription fees are billed in advance and may auto renew unless canceled,

  • usage based charges may apply (for example page views, events, Submissions, AI credits),

  • fees are non refundable except where required by law or expressly stated by PostPaddy,

  • you are responsible for applicable taxes except taxes on PostPaddy’s income.

  1. Suspension and termination

10.1 Suspension

We may suspend or limit access immediately if:

  • you violate these Terms,

  • you publish prohibited content,

  • your Pages create legal, security, or reputational risk,

  • we detect fraud, abuse, or unusual activity,

  • you fail to pay fees when due.

10.2 Termination

You may stop using the Service at any time. We may terminate your account for cause.

10.3 Effect of termination

Access ends. We may delete or de identify Customer Content and related data after a reasonable period, subject to lawful retention and backup cycles.

  1. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non infringement, and availability.

We do not guarantee uptime, uninterrupted hosting, or error free operation.

  1. Limitation of liability

To the maximum extent permitted by law:

  • PostPaddy is not liable for indirect, incidental, special, consequential, punitive, or lost profits damages.

  • PostPaddy’s total liability for all claims relating to the Service is limited to the fees you paid to PostPaddy for the Service in the 12 months before the event giving rise to liability.

  1. Indemnification

You will defend and indemnify PostPaddy and its affiliates, officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from:

  • your Pages, Customer Content, and offers,

  • your visitor data collection, tracking, and consent practices,

  • your communications with leads collected through the Service,

  • your use of Third Party Services,

  • your violation of law or these Terms.

  1. Dispute resolution and governing law

Governing law. These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of laws rules.

Informal resolution. Before filing a claim, each party agrees to try to resolve disputes informally by written notice and good faith discussion for at least 30 days.

Arbitration; class action waiver. If not resolved, disputes will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. You and PostPaddy waive jury trials and class actions. Either party may bring eligible claims in small claims court.

  1. Export controls and sanctions

You must comply with applicable export controls and sanctions laws. You may not use the Service if you are a prohibited party or in a restricted country.

  1. Changes

We may update these Terms. For material changes, we will provide notice (for example, in app or by email). Continued use after the effective date means you accept the updated Terms.
